The measures for the management of press cards are as follows:

1. Infringement is embodied in news works, which is the first element of news infringement and an important difference between news infringement and other general infringements. If the perpetrator does not infringe upon the legitimate rights and interests of the victim by publishing the news work, but disseminates derogatory content through language and writing in the victim's living area by posting posters of large and small characters, even if there are harmful facts, it can only be found to be an ordinary civil tort and does not constitute a news infringement;

2. The news work with infringing content has been publicly published, which is another important condition for constituting news infringement, and it is also the key to distinguish whether the fact of damage exists. Only when the news work with infringing content has been officially published can the objective authenticity and certainty of the news infringement be determined. If the journalistic work is not published, the fact of such damage cannot be confirmed;

3. The fact that the victim of the news infringing work can be identified if it has an identifiable object should be the third constitutive element of news infringement, and since the publication of the news work with infringing content leads to the identification of the victim in real life, thereby causing the derogation of his material and moral rights and interests, the publication of the news work is the cause of the occurrence of the fact of damage. A journalistic work that has infringed acts can only be held liable if there is an identifiable object to which the journalistic work exists;

4. The news organization has legitimacy and is at fault in the news activities, which is a requirement for the news organization in the journalistic infringement.

Citizens have the right to make criticisms and suggestions to State organs and State functionaries, and to complain, accuse and denounce their dereliction of duty.

Article 1: These Measures are formulated on the basis of relevant laws and regulations and decisions so as to standardize the management of journalists' cards, ensure the normal reporting activities of journalists, and safeguard the lawful rights and interests of journalists and the public.

Article 2: These measures apply to the application, issuance, use, and management of press cards.

To engage in news gathering and editing activities within the territory of the People's Republic of China, a press card issued by the General Administration of Press and Publication must be held.

Article 3: A press card is a valid proof of a journalist's professional identity, and is the only legal certificate for journalists within the territory to engage in news gathering and editing activities, and is uniformly printed and issued by the General Administration of Press and Publication in accordance with law.

Domestic news organizations use a uniform form of press card.

What are the regulations and responsibilities?

The General Administration of Press and Publication and the administrative departments of press and publication of all provinces, autonomous regions and municipalities directly under the Central Government are responsible for supervising and managing the issuance, use and annual review of press cards of news organizations.

The supervisory unit of a news organization shall perform the management responsibility of reviewing the application and regulating the use of the press card of the news organization to which it belongs, and shall deal with the news organization and news gathering and editing personnel who violate these Measures in accordance with the law, and if the circumstances are serious, apply to the issuing organ for cancellation of their press card.

News organizations shall perform the responsibility of reviewing the qualifications of their news gathering and editing personnel and applying, issuing, using, and managing press cards, and supervise and manage the reporting activities of press card holders.

News organizations shall promptly organize an investigation and handling of reports of violations of law and discipline by the holders of their press cards, and where the circumstances are serious, they shall apply to the issuing organ for cancellation of their press cards.

Summary: No organization or individual may interfere with or obstruct the lawful reporting activities of news organizations and their journalists.

Legal basis: Article 29 of the "Measures for the Administration of Press Cards" news organizations shall regularly publicize the list of press card holders and the list of new applicants for press cards every year, and publish the ** and reports of the "National Press Card Management and Verification Network System" on the ** to which they belong, so as to facilitate the public to verify press cards and accept supervision.
