Legal Analysis: Joining the WTO will help win and maintain China's right to speak on the international economic stage and create an international environment conducive to its own development. China and the WTO need each other, and excluding China, a rising world power and the largest actual and potential market, from the WTO will not only deprive China of the legal basis for fulfilling its multilateral concession obligations, but will also inevitably undermine the universal and effective operation of the new multilateral system.
Legal basis: Foreign Affairs Law of the People's Republic of China
Article 1: This Law is formulated in order to expand opening up to the outside world, develop foreign business operations, maintain foreign order, protect the lawful rights and interests of foreign business operators, and promote the healthy development of the socialist market economy.
Article 2 This Law applies to the protection of intellectual property rights related to foreign affairs and foreign countries.
For the purposes of this Law, the term "foreign affairs" refers to the import and export of goods, the import and export of technology, and international services.
Article 3: The competent departments for foreign affairs are in charge of national foreign affairs work in accordance with this Law.
Article 4: The State implements a unified foreign affairs system, encourages the development of foreign affairs, and maintains a fair and free foreign affairs order.
Article 5 The People's Republic of China, in accordance with the principle of equality and mutual benefit, promotes and develops relations with other countries and regions, concludes or participates in regional economic agreements such as customs union agreements and free zone agreements, and participates in regional economic organizations.
