Regulations on Conscription

It was promulgated by the Military Commission on October 24, 1985 and amended in accordance with the decision of the Military Commission on September 5, 2001 on amending the Regulations on Conscription.

Chapter I: General Provisions.

Article 1: These Regulations are formulated in accordance with the relevant provisions of the "Military Service Law of the People's Republic of China".

Article 2: The recruitment of new recruits is an important task in strengthening the building and defense of the armed forces, and the people at all levels and military organs at all levels shall conscientiously do a good job.

Article 3 Male citizens who have reached the age of 18 before December 31 of each year shall be conscripted for active service. Those who were not conscripted in the current year may still be conscripted for active duty until the age of 22.

On the basis of the needs of the military, female citizens may be recruited for active service in accordance with the provisions of the preceding paragraph.

In accordance with the needs of the armed forces and the principle of personal voluntariness, male and female citizens who have reached the age of 17 but have not yet reached the age of 18 before December 31 of the current year may be conscripted for active service.

Citizens with severe physical impairment or severe disability who are not fit for military service are exempt from conscription. Conscripts who are the sole labor force to support their families or who are students who are enrolled in full-time school may be deferred.

Persons deprived of their political rights in accordance with the law shall not be recruited. Citizens who are under investigation, prosecution, or trial, or who have been sentenced to imprisonment, short-term detention, or controlled release and are currently serving a prison sentence are not to be recruited.

Article 4 The annual number of conscripts, requirements, and time for conscription in the whole country shall be prescribed by the conscription orders of the Military Commission.

Article 5 All provinces, autonomous regions, and municipalities directly under the Central Government shall make arrangements for conscription work in their respective regions in accordance with the conscription orders of the Military Commission.

When allocating conscription tasks, all provinces, autonomous regions, and municipalities directly under the Central Government shall, in accordance with the number and quality of conscripted citizens in each locality and the production and living conditions of the masses, make overall plans and rational distribution, and give priority to ensuring the recruitment of conscripts with special conditions. It may be recruited on a rotational basis by region or county; In areas or counties where the disaster is more serious, the conscription task may be reduced or waived as appropriate.

Article 6 The State shall, on the basis of the needs of mobilization, systematically divide the recruitment areas for technical troops throughout the country. All provinces, autonomous regions, municipalities directly under the Central Government, and military units shall recruit and supplement technical troops in accordance with the designated areas.

Article 7 The national conscription work shall be organized and implemented by the Ministry of National Defense under the leadership of the Military Commission, and the specific work shall be undertaken by the Conscription Office of the Ministry of National Defense.
