Legal analysis: (1) Adjust the responsibilities of animal health supervision agencies.

The new law clarifies that "the animal health supervision institutions of local people at or above the county level shall be responsible for the quarantine of animals and animal products in accordance with the provisions of this law". Although the new law does not change the wording of animal health supervision bodies, the functions of animal health supervision bodies have changed. In the original law, "responsible for the quarantine of animals and animal products and other supervision, management and law enforcement work related to animal epidemic prevention" was adjusted to "responsible for the quarantine of animals and animal products".

It should be noted that, in accordance with the requirements of the new law, only the animal health supervision institutions of the local people at or above the county level can implement animal quarantine, and the departments that undertake animal quarantine functions in areas without animal health supervision institutions or without the approval of the establishment department shall not implement animal quarantine work.

Article 1 This Law is enacted in order to strengthen the management of animal epidemic prevention activities, to prevent, control, purify and eliminate animal diseases, to promote the development of the breeding industry, to prevent and control zoonotic infectious diseases, and to ensure public health safety and human health.

Article 2: This Law applies to animal epidemic prevention and its supervision and management activities within the territory of the People's Republic of China.

The quarantine of imported and exported animals and animal products shall be governed by the Law of the People's Republic of China on the Quarantine of Imported and Exported Animals and Plants.

Legal Analysis: January 22, 2021. The laws and regulations were amended and adopted by the 25th Session of the Standing Committee of the 13th National People's Congress of the People's Republic of China and will come into force on May 1, 2021.
