Article 1These Measures are formulated in accordance with the provisions of the "Measures for the Administration of Internet Information Services", the "Measures for the Administration of the Security Protection of International Networking of Computer Information Networks" and other relevant laws and other administrative regulations, so as to strengthen the management of Internet access service business sites, promote the healthy development of Internet access service activities, and protect the lawful rights and interests of Internet users.

Article 2These Measures apply to establishment, operation, and use of Internet access service business sites within the territory of the People's Republic of China, as well as to the implementation of supervision and management of them.

"Internet access service business premises" as used in these Measures refers to business establishments that provide Internet access services to the public through the networking of computers and Mutual Mega Networks (including Internet access services provided by "Internet cafes").

Article 3The departments in charge of the information industry and the telecommunications management bodies of provinces, autonomous regions, and municipalities directly under the Central Government are responsible and have the responsibility to organize, coordinate, supervise and inspect the relevant departments at the same level, and within the scope of their respective responsibilities and in accordance with the provisions of these Measures, be responsible for the supervision and management of Internet access service business premises.

Provincial, autonomous regional, and directly governed municipality telecommunications regulatory bodies are responsible for the examination and approval of business licenses and the supervision of service quality for Internet access service business premises.

The public security departments are responsible for the security review of Internet access service business premises and the investigation and handling of violations of network security management provisions.

The cultural department is responsible for investigating and dealing with unhealthy computer games that contain pornography, gambling, violence, ignorance, superstition, and other unhealthy computer games in Internet access service business premises.

The administrative department for industry and commerce is responsible for the issuance of business licenses for Internet access service business premises and the investigation and handling of illegal acts such as operating without a license or exceeding the scope of business.

Article 4The establishment of an Internet access service business premises shall be subject to the review and approval of the relevant departments, and the provision of services shall be provided only after obtaining a business license and completing the registration of the enterprise.

Those who have not obtained the examination and approval documents, business licenses, and have not gone through the registration of the enterprise clan and the establishment of the enterprise shall not open an Internet access service business premises.

Article 5The establishment of Internet access service business premises shall comply with laws, administrative regulations, and the provisions of these Measures, provide good services, strengthen industry self-discipline, and accept the supervision and management carried out by relevant departments in accordance with law.

Citizens, legal persons, and other organizations have the right to conduct social oversight of Internet access service business premises.

Users who go online at Internet access service business sites shall abide by the provisions of laws and administrative regulations, abide by social mores, exercise strict self-discipline, use the Internet in a civilized manner, and carry out healthy and civilized online activities.

Neither.

1.The computers provided to online consumers are not connected to the Internet through local area networks;

2.Failure to establish an on-site inspection system, or failure to stop the illegal acts of online consumers and report them to the administrative departments for culture or public security organs;

3.Failure to follow provisions to check or register the valid identity documents of online consumers or to record relevant online information;

4.Changing the name, domicile, legal representative or principal responsible person, registered capital, network address, or terminating business activities, without going through the relevant formalities or filing with the administrative department for culture or public security organs.

The Regulations on the Administration of Internet Access Service Business Premises are laws and regulations formulated for the purpose of strengthening the management of Internet access service business premises, regulating the business conduct of business operators, safeguarding the legitimate rights and interests of the public and business operators, ensuring the healthy development of Internet access service business activities, and promoting the construction of socialist spiritual civilization.

On September 29, 2002, the Regulations on the Administration of Business Premises for Internet Access Services were promulgated by Order No. 363 of the People's Republic of China and came into force on September 29, 2002.

According to the first revision of the Decision on the Repeal and Amendment of Some Administrative Regulations of the People's Republic of China on January 8, 2011 No. 588; According to the second revision of the Decision of the People's Republic of China on Amending Some Administrative Regulations No. 666 of the People's Republic of China on February 6, 2016.

Internet access service business premises business units engaged in Internet access service business activities shall meet the following requirements:

1) Have the name, domicile, organizational structure and articles of association of the enterprise;

2) Have funds suitable for their business activities;

3) There are business premises that are suitable for their business activities and meet the fire safety conditions stipulated by the state;

4) Have a complete and complete information network security management system and security technical measures;

6) There are safety management personnel, management personnel, professional and technical personnel who are suitable for their business activities and have obtained qualifications;

7) Other conditions stipulated by laws, administrative regulations and relevant departments.

In fact, it is good to register a company and provide services through the Internet, which is not much different from ordinary companies.

The establishment of an Internet access service business premises business unit shall adopt the organizational form of the enterprise and meet the following conditions: 1. The name, domicile, organizational structure and articles of association of the enterprise must be established; 2. There should be funds suitable for its business activities; 3. There should be a business place that is suitable for its business activities and meets the fire safety conditions stipulated by the state; 4. It is necessary to have a sound and perfect information network security management system and security technical measures; 5. Have a fixed network address and computers and other devices and ancillary equipment suitable for its business activities; 6. There should be safety management personnel, management personnel, professional and technical personnel who are suitable for their business activities and have obtained qualifications; 7. It shall comply with other conditions stipulated by national laws, administrative regulations and relevant departments.
