The Cyberspace Administration of China (CAC) recently issued the Provisions on the Online Protection of Children's Personal Information (hereinafter referred to as the "Provisions"). The Provisions came into force on October 1, 2019, and clarified that no organization or individual may produce, publish, or disseminate information that infringes on the security of children's personal information.

The Provisions make it clear that when network operators collect, store, use, transfer, or disclose children's personal information, they shall follow the principles of legitimate necessity, informed consent, clear purpose, security assurance, and lawful use. Network operators shall set up special rules and user agreements for the protection of children's personal information, and designate designated personnel to be responsible for the protection of children's personal information. Where network operators collect, use, transfer, or disclose children's personal information, they shall do so.

The Supreme People's Court and the Supreme People's Procuratorate have issued the Interpretation on Several Issues Concerning the Application of Law in Handling Criminal Cases of Infringement of Citizens' Personal Information. The Cybersecurity Law clearly stipulates that "network operators shall keep the user information they collect strictly confidential, and establish and improve a system for the protection of user information".

In order to further promote network service providers to truly perform their obligations to protect personal information security, the judicial interpretation provides that where network service providers refuse to perform their information network security management obligations as provided for by laws and administrative regulations, and refuse to make corrections after being ordered to do so by the regulatory departments, causing the user's citizens' personal information to be leaked, causing serious consequences, they shall be convicted and punished as the crime of refusing to perform information network security management obligations in accordance with article 286-1 of the Criminal Law.

On June 1, 2017, the Cybersecurity Law, the Measures for the Security Review of Network Products and Services, the Provisions on the Administration of Internet News Information Services, and the Interpretation on Several Issues Concerning the Application of Law in Handling Criminal Cases of Infringement of Citizens' Personal Information will come into effect.
