In order to standardize the procedures for formulating traffic laws and regulations and traffic legislation, and to ensure the quality of traffic legislation, the regulations on the procedures for formulating traffic laws and regulations are formulated in accordance with the "Legislation Law of the People's Republic of China", the "Regulations on the Procedures for the Formulation of Administrative Regulations" and the "Regulations on the Procedures for the Formulation of Rules".
The following principles should be followed in the development of traffic laws:
1. Traffic laws and regulations shall conform to the line, principles and policies of the Party and the state;
2. Administrative rules shall not contradict the Constitution, laws, administrative regulations, decisions and orders; Draft administrative regulations must not contradict the Constitution or laws; Draft laws must not contradict the Constitution;
3. Traffic laws and regulations should meet the actual needs of the management of the transportation industry, proceed from the overall situation and seek truth from facts;
4. Traffic laws and regulations should meet the overall requirements of the traffic law system;
5. The matters stipulated in the administrative regulations shall not exceed the statutory authority of the Ministry of Communications.
The content of traffic laws or socks should be complete and standardized, generally including the following matters:
1. The purpose, basis and principles of formulation;
2. Adjustment object, scope of application and competent authority;
3. The rights, obligations and legal responsibilities of the subject;
4. Explain ownership;
5. The effective date and the regulations or documents that need to be repealed.
Article 5 of the Road Traffic Safety Law of the People's Republic of China *** The public security department is responsible for the management of road traffic safety throughout the country. The traffic management departments of local people's public security organs at or above the county level shall be responsible for the management of road traffic safety within their respective administrative areas.
The people's transportation and construction management departments at or above the county level are responsible for the relevant road traffic work in accordance with their respective duties.
Article 6 The people at all levels shall regularly carry out road traffic safety education to improve citizens' awareness of road traffic safety.
When performing their duties, the traffic management departments of public security organs and their traffic police shall strengthen the publicity of road traffic safety laws and regulations, and abide by road traffic safety laws and regulations in an exemplary manner.
Government organs, military units, enterprises, public institutions, social organizations and other organizations shall conduct road traffic safety education for the personnel of their units.
Administrative departments for education and schools shall include road traffic safety education in the content of legal education.
Press, publishing, radio, television and other relevant units have the obligation to carry out road traffic safety education.
