Article 7: The Ministry of Justice is to uniformly organize the National Basic-Level Legal Service Workers' Practice Qualification Examinations, and the provincial-level judicial-administrative organs are responsible for undertaking them. Approval of the practice of basic-level legal service workers.

Basis: "Decision on the Establishment of Administrative Licenses for Administrative Examination and Approval Items that Really Need to Be Retained" and "Measures for the Management of Grassroots Legal Service Workers".

Conditions: 1) Uphold the Constitution, abide by the law, and have the right to vote and be elected (Article 13, Paragraph 1, Tongheng, Item 3 of the Measures for the Administration of Grassroots Legal Service Workers);

2) Have a bachelor's degree or above in law from a college or university, or have a college degree or above and have been engaged in adjudication, procuratorial work, judicial administrative work, or people's congress or legal work for at least 5 years, or have one of the following qualifications: lawyer qualifications; Notary qualifications; Corporate Legal Counsel Qualifications; Qualifications for Basic-level Legal Service Workers (Article 13, Paragraph 1, 5, and 8 of the Measures for the Administration of Basic-level Legal Service Workers);

3) Have been interning at a grassroots legal service firm for 6 months and have been identified by the firm (except for more than 2 years of work as a lawyer, notary, corporate legal counsel, trial, procuratorial business, judicial administration business, and other legal operations before applying for practice registration) (Article 13, Paragraph 1, Item 1, and Article 13, Paragraph 2 of the "Measures for the Administration of Grassroots Legal Service Workers");

4) Be of good character (Article 13, Paragraph 1, Item 3 of the Measures for the Administration of Basic-level Legal Service Workers);

5) Be in good health (Article 13, Paragraph 1, Item 3 of the "Measures for the Administration of Basic-level Legal Service Workers");

6) Decisions on hiring by grassroots legal service offices (Article 13, Paragraph 1, Item 2 of the "Measures for the Administration of Grassroots Legal Service Workers").

Procedure and deadline:

The applicant shall submit an application to the Administrative Licensing Acceptance Department of the Municipal Bureau of Justice and submit the relevant application materials, and the Municipal Bureau of Justice shall accept and make a decision on approval or disapproval within the time limit specified in the Administrative Licensing Law of the People's Republic of China. After examination and approval, the practice registration shall be made within 10 days, and the "Legal Leasing Circular Law Service Worker Practice Certificate" shall be issued.

I. Those engaged in basic-level legal service work shall have the professional qualifications for basic-level legal escort services. Persons who meet the following requirements may obtain basic-level legal service worker practice credentials through examinations:

1. Support the Constitution, abide by the law, and have the right to vote and to be elected;

2. Have a high school or secondary professional degree or above;

3. Good conduct; 4. Be in good health.

II. The following persons who meet the requirements of items (1), (3), and (4) above and are able to engage in basic-level legal service work full-time may apply to obtain basic-level legal service worker practice qualifications in accordance with the evaluation procedures.

1. Have a bachelor's degree or above in law from a college or university;

2. Have a college degree or above in the national education series, and have been engaged in adjudication, procuratorial business, judicial administrative work, or people's congress or legal work for five years.

III. Where applications are made for evaluation to obtain basic-level legal service workers' practice credentials, the district and county (autonomous county, city) judicial administrative departments are to evaluate and submit opinions, and report to the municipal judicial administrative departments for review and approval.

IV. For those who pass the examination or assessment, the municipal judicial administrative department is to report to the Ministry of Justice for the issuance of the "Basic Level Legal Service Service Worker Practice Qualification Certificate".

V. Persons who have obtained basic-level legal service worker practice credentials, or who have lawyer qualifications, notary public qualifications, or enterprise legal counsel qualifications, may apply for basic-level legal service worker practice registration if they meet the following requirements.

1. Internship in the grassroots legal service firm for 1 year, and be qualified by the firm;

2. The grassroots legal service firm decides to hire.

Those who have worked as lawyers, notaries, corporate legal counsel, adjudication, procuratorial work, judicial administrative work, and other legal work for more than two years before applying for practice registration may apply for practice registration without internship.

VI. Applications for practice registration shall complete the "Basic Level Legal Service Worker Practice Registration Form" and submit the following materials.

1. The applicant's primary legal service worker qualification certificate, or lawyer, notary, or corporate legal counsel qualification certificate;

2. Appraisal opinions on internship performance of grassroots legal service offices;

3. Proof of consent to hire the applicant issued by the grassroots legal service office.

4. Health status certificate; 5. Other materials required by the registration authority.

VII. Procedures for applying for a practice certificate for basic-level legal service workers.

1. The application materials for practice registration shall be submitted to the competent judicial-administrative organ for review by the grass-roots legal service office where the applicant is to be employed, and the in-charge judicial-administrative organ shall make a decision to approve or disapprove practice registration within 30 days of receiving the application materials.

2. For those who are approved to practice registration, a legal worker's practice certificate shall be issued. If the practice registration is not granted, the applicant shall be notified in writing.

3. If the applicant has any objection to the decision not to register for practice, he or she may apply for administrative reconsideration within 60 days from the date of receipt of the decision or directly file a lawsuit with the people's court within 3 months.

Apply to the judicial-administrative organs at the districted city level or directly under the Central Government's district (county), and receive a "Basic Level Legal Service Worker Practice Certificate" after approval.

Article 10 of the "Measures for the Administration of Basic-level Legal Service Workers" applies for approval of the practice of basic-level legal service workers, they shall fill out an application for practice registration form and submit the following materials:

A) in accordance with the provisions of Article 6 of the academic certificates and examination certificates, or Article 7 of the qualification certificates;

2) The basic level legal service office's appraisal opinion on the applicant's internship performance, or proof that he or she has two or more years of experience in other legal professions;

3) Proof of consent to accept applicants issued by basic-level legal services;

4) Proof of identity of the applicant.

Article 11: Materials for application for practice approval are to be submitted by the basic level legal service office where the applicant is to be hired to the county-level judicial-administrative organ for review, and after they issue a review opinion, report to the judicial-administrative organ at the districted-city level for review, or the district (county) division and administrative organ for the location of the directly governed municipality where the basic level legal services to be hired are to report for review.

Article 12: The practice approval organ shall complete the review within 20 days of the decision to accept the application, and make a written decision to approve or disapprove the practice. Where practice approval is not granted, the reasons shall be explained in the decision.

For applicants who are approved to hold key businesses, the practice approval organ is to issue a "Practice Certificate for Basic-level Legal Service Workers".

If the applicant has objections to the decision not to approve the practice, he may apply for administrative reconsideration in accordance with the "Administrative Reconsideration Law of the People's Republic of China" and the relevant provisions of the Ministry of Justice.
