Enterprises that have obtained professional contracting qualifications (hereinafter referred to as professional contracting enterprises) may undertake professional projects subcontracted by general construction contracting enterprises and professional projects contracted by construction units in accordance with the law. A professional contractor may construct all the professional projects it undertakes on its own, or may subcontract the labor service operations to a labor subcontractor with corresponding qualifications in accordance with the law.

Units contracting foreign projects shall meet the following conditions:

1) Have the status of a legal person; The project construction unit shall have a registered capital that is compatible with its qualification requirements (the registered capital referred to in these measures includes the start-up capital); The registered capital of non-engineering construction units shall not be less than 20 million yuan.

2) Have the corresponding qualifications or performance: the project construction unit shall, in accordance with the law, obtain the special grade or grade 1 (grade A) qualification certificate issued by the competent department of housing and urban-rural development or other relevant departments; Where the state does not classify relevant professional qualifications, it shall obtain a qualification certificate; The export volume of mechanical and electrical products of non-engineering construction units in the previous year reached 50 million US dollars, or the export value of self-designed and produced (including organized production), the export volume of sales of sensitive sets of equipment or large-scale stand-alone equipment reached 10 million US dollars, or the turnover of foreign contracted projects reached 10 million US dollars, and three projects with a single contract value of more than 5 million US dollars were successfully implemented in the past three years.

3) There are professional and technical personnel suitable for foreign contracted projects, and at least 2 of the management personnel have been engaged in foreign contracted projects for more than 2 years.

4) Possess the safety capability corresponding to the foreign contracted project, establish an overseas safety leading group under the responsibility of the main person in charge of the unit, with no less than 2 permanent personnel, and have the corresponding overseas safety mechanism and emergency plan.

5) The management system of project quality and safety production. In the past two years, there have been no major project quality problems and production safety accidents above major accidents, and the construction enterprise must also obtain a safety production license issued by the competent department of housing and urban-rural construction.

6) Have a good business reputation, and have no major breach of contract and major illegal business record in the past 3 years. For foreign-invested enterprises in Youkong, they should pass the joint annual inspection of foreign-invested enterprises in the last three consecutive years.

Article 26 of the Construction Law of the People's Republic of China The unit contracting construction projects shall hold the qualification certificate obtained in accordance with the law and undertake the project within the business scope permitted by its qualification level.

It is forbidden for construction enterprises to exceed the business scope permitted by the qualification level of the enterprise or to contract projects in the name of other construction enterprises in any form.
