Article 2 Within the territory of the People's Republic of China, those engaged in food sales and catering service activities shall obtain a food business license in accordance with the law.

Article 3 The food business license shall follow the principles of law, openness, fairness, justice, convenience and efficiency.

Article 4 The principle of one place and one license shall be implemented for food business license, that is, food business operators engaged in food business activities in one business premises shall obtain a food business license.

Article 5 The food and drug supervision and administration department shall implement the classification and licensing of food business according to the business format of the food business entity and the risk degree of the business project.

Article 6 The State Food and Drug Administration is responsible for supervising and guiding the administration of national food business licenses.

Legal Analysis: The catalogue of raw materials of health food and the catalogue of health functions that allow health food to be claimed shall be formulated, adjusted and published by the food and drug supervision and administration department in conjunction with the health administrative department and the state administration department of traditional Chinese medicine. The catalogue of health food raw materials shall include the name of the raw materials, the dosage and the corresponding efficacy; The raw materials included in the catalogue of health food raw materials can only be used in the production of health food, and shall not be used in the production of other foods.

Article 12 The following conditions shall be met when applying for a food production license: (2) Have production equipment or facilities suitable for the variety and quantity of food produced, and have corresponding equipment or facilities for disinfection, dressing, washing, lighting, lighting, ventilation, anti-corrosion, dust, fly-proof, rodent-proof, insect-proof, washing, wastewater treatment, and storage of garbage and waste; If the health food production process includes pre-treatment processes such as raw material extraction and purification, it is necessary to have raw material pre-treatment equipment or facilities that are suitable for the variety and quantity of production.

Article 14 To apply for a production license for health food, formula food for special medical purposes and formula food for infants and young children, the production quality management system documents and relevant registration and filing documents corresponding to the food produced shall also be submitted.
