Where a mentally ill person transferred by the public security organs or discovered in the course of review for prosecution meets the requirements for compulsory treatment, the people's procuratorate shall submit an application for compulsory treatment to the people's court. Where in the course of hearing a case, the people's court discovers that the defendant meets the requirements for compulsory treatment, they may make a decision on compulsory treatment.
For mentally ill persons who commit violent acts, the public security organs may employ temporary protective restraint measures before the people's courts decide on compulsory treatment.
Article 286:After people's courts accept applications for compulsory treatment, they shall form a collegial panel to conduct trial.
People's courts hearing compulsory treatment cases shall notify the legally-designated person of the subject of the application or defendant to appear. Where the subject of the application or defendant has not retained a litigant, the people's court shall notify the legal aid institution to appoint a lawyer to provide them with legal assistance.
Article 287:If, upon trial, the people's court meets the requirements for compulsory treatment in the subject of the application or defendant, it shall make a compulsory treatment decision within one month.
Where the person subject to a compulsory treatment decision, the victim, their legally-designated ** person, or close relatives are dissatisfied with the compulsory treatment decision, they may apply to the people's court at the level above for reconsideration.
Article 288:Compulsory treatment establishments shall periodically conduct diagnostic assessments of persons subject to compulsory treatment. Where there is no longer a personal danger and there is no need to continue compulsory treatment, an opinion on the release shall be promptly submitted and reported to the people's court that made the compulsory treatment decision for approval.
Persons subject to compulsory treatment and their close relatives have the right to apply for the removal of compulsory treatment.
Article 289: The People's Procuratorate supervises the decision and implementation of compulsory treatment.
