Legal analysis: According to the provisions of China's Civil Code, if the relationship between the husband and wife has indeed broken down and can no longer continue to live together, either spouse has the right to file for divorce. In accordance with the Civil Code and relevant legal provisions, the joint property of the parties to the divorce is based on the principle of taking care of the legitimate rights and interests of the woman and the children, and taking care of the innocent party, while taking into account the specific circumstances of the property, the respective economic income of both parties, and the support of the children after the divorce, and finally make a fair judgment in accordance with the law.
