With the high development of production, the increasing sophistication of technology, the increasingly complex production and marketing process, and the asymmetry of information and incomplete information put consumers at a disadvantage in the possession of information resources. With the expansion of commodity production scale and the acceleration of industrialization, the structure of commodities has become increasingly complex. As a single person, the consumer's ability to perceive is limited. More importantly, because manufacturers have an active position in the possession and dissemination of information, it is difficult for them to provide information to consumers objectively, impartially and comprehensively, and may even provide untrue information.

This contradiction between information possession and information demand has further deepened consumers' ignorance and misunderstanding, and the possibility of producers and operators infringing on consumers' interests has also intensified. Consumers are at a significant disadvantage in terms of economic power, and manufacturers tend to be companies with deep capital and complex organizational structures. This allows producers and operators to take advantage of their dominant position to force consumers to accept their harsh trading conditions.

At this stage, with the rapid development of global economic integration, compared with the transnational business activities of manufacturers, the weak position of consumers is more prominent, and the infringement of consumer interests is becoming increasingly internationalized, which also makes the legislative activities to strengthen consumer protection gradually develop into a worldwide. In this process, the socialization and specialization of production and operation often make it difficult for consumers to find and hold accountable those who infringe on their rights by themselves. At the same time, the high cost of litigation in accordance with ordinary civil litigation procedures is often prohibitive for consumers.

It can be seen that it is difficult to improve the vulnerable position of consumers by relying on the spontaneous role of the market mechanism, and the fundamental solution is still the need for active intervention of the first to make up for market defects through the system and improve relevant laws to provide effective protection for consumers.
