In our country, reporting is a democratic right of citizens, and the enjoyment of this right by citizens is not a gift from anyone, but is provided for by our Constitution and laws. Article 41 of China's Constitution stipulates: "Citizens of the People's Republic of China have the right to criticize and make suggestions to any State organ or functionary; They have the right to lodge complaints, accusations, or reports to the relevant organs against any state organ or state functionary for their illegal or dereliction of duty, but they must not fabricate or distort facts to make false accusations and frame-ups.

With regard to citizens' complaints, accusations, or reports, the relevant state organs must ascertain the facts and be responsible for handling them. No one shall be silenced or retaliated against". In order to ensure the realization of citizens' right to report under the Constitution, China's laws have made specific and clear provisions in this regard.

Paragraphs 1 and 3 of Article 84 of the Criminal Procedure Law stipulate: "Any unit or individual has the right and obligation to report or report to the public security organs, people's procuratorates or people's courts when they discover the facts of a crime or a criminal suspect" and "the public security organs, people's procuratorates or people's courts shall accept any reports, accusations or reports." Where it is not within their own jurisdiction, it shall be transferred to the competent organs for handling, and the informant, accuser, or informant shall be notified; Where emergency measures must be taken that are not within their jurisdiction, they shall first take emergency measures and then transfer them to the competent organs".

Paragraph 3 of Article 85 provides: "Public security organs, people's procuratorates, or people's courts shall ensure the safety of informants, accusers, informants, and their close relatives. If the informant, accuser, or informant is unwilling to disclose his or her name or the conduct of the report, accusation, or report, he shall keep it confidential."

Article 254 of the Criminal Law stipulates: "Where a functionary of a state organ abuses his power or falsely seeks public benefit for personal gain, and retaliates against an accuser, complainant, critic, or informant, he shall be sentenced to fixed-term imprisonment of not more than two years or short-term detention; where the circumstances are serious, the sentence is to be between two and seven years imprisonment." It is not difficult to see from the above-mentioned provisions of the Constitution and the law that reporting is a broad democratic right granted to citizens by law, and as long as citizens discover the facts of a crime or a criminal suspect, they can report it to the relevant organs.

Through the form of reporting, citizens realize the democratic rights granted by the law to manage state affairs and supervise state functionaries, and are strictly protected by state laws. It should be noted that the rights and obligations of citizens are consistent, especially the rights and obligations of citizens to report, which are both unified and of a dual nature. Reporting is both a right and an obligation.

While enjoying the right to report as stipulated in the Constitution and the law, citizens must also fulfill the obligation to report as stipulated in the Constitution and the law, and have the right and obligation to boldly report any illegal or criminal acts as long as they are discovered. Only in this way can the powers conferred by the Constitution and the law be truly enjoyed and realized.
