International conventions and compensation standards relating to the liability of maritime air carri

Insured shipping. It refers to the value of the goods declared by the shipper as determined jointly by the transport enterprise and the shipper. Based on a special mode of transportation, the insured value is that the shipper declares to the carrier the actual value of the consignment.

For the goods transported according to the insured value, the shipper shall pay a certain insurance fee in addition to the transportation costs.

In the insured transportation, if the goods are all lost, the compensation shall be declared according to the insured value of the goods; If the goods are partially damaged or lost, compensation shall be made according to the actual loss; If the actual loss of the goods is higher than the declaration, compensation shall be made according to the declaration; If the goods can be repaired, compensation shall be made according to the repair cost plus the maintenance and delivery fee.

The 15th Session of the Standing Committee of the Seventh National People's Congress passed the Railway Law of the People's Republic of China on September 7, 1990, which was promulgated by Order No. 32 of the People's Republic of China on the same day and came into force on May 1, 1991. Article 17 stipulates that railways shall be subject to limited compensation and insured transportation.

China has relevant regulations on insured transportation of baggage and cargo in the railway, civil aviation and water transport industries. The Railway Law of the People's Republic of China stipulates that: "If the shipper applies for insured transportation on a voluntary basis, it shall compensate according to the actual loss, but the maximum shall not exceed the insured amount."

The Civil Aviation Law and the Maritime Law adopt different compensation standards for liability compensation for domestic and international transportation, mainly considering the difference between China's national income and that of other countries. In international transportation, the principles and standards stipulated in international conventions are adopted in the vast majority of cases, which basically reflects the provisions of the international transport conventions to which China has acceded. The Civil Aviation Law stipulates that the liability limits of international air transport carriers shall be implemented in accordance with the following provisions:

The limit of liability for each passenger is 16,600 units of calculation; provided, however, that the Passenger may agree in writing with the Carrier to limit the liability in excess of the limits set forth in this Paragraph. The limit of liability for checked baggage or cargo is 17 units per kilogram. The limit of liability for each passenger's carry-on item is 332 units of calculation.

I took a look at the list of the transportation company myself, and it was more detailed than what others said, and what others said was of no use to the actual situation.

1. Handle the responsibility of making the ship seaworthy with care.

2. Responsibility for proper and prudent management of goods.

3. Responsibility for the ship not to carry out unreasonable deviations.

4. The responsibility of the ship for reasonable dispatch.

5. Liability for damages.

The Hague Rules provide for the liability of the carrier.

1) Careful handling of the ship makes it seaworthy. Article 3, paragraph 1, of the Hague Rules provides that the carrier must exercise care before and at the time of sailing1 to make the ship seaworthy,2 properly crewed, equipped, and equipped with **,3 to make the hold, refrigerated, air-conditioned and other places of the ship fit and safe to receive, carry and keep the cargo.

2) Manage the goods properly and carefully. Article 3, paragraph 2, of the Hague Rules provides that the carrier shall properly and carefully load, move, stow, transport, keep, care for and discharge the goods.

In addition, article 4, paragraph 5, of the Hague Rules provides that neither the carrier nor the ship shall be liable for loss of or damage to the goods in connection with the goods in any event when the amount or unit exceeds £100 or its equivalent in other currencies, unless the shipper has declared the nature and value of the goods prior to shipment and indicated them on the bill of lading.
