What are the main features of internet crime?

Cybercrime has some unique characteristics: it is low-cost, spreads quickly, and spreads widely; High interactivity and concealment, and difficulty in obtaining evidence; serious social harm; Cybercrime is a classic computer crime.

There are three types of Internet crimes: 1. False advertising. Pursuant to Article 222 of the Criminal Law:

Where advertisers, advertising agents, or advertisement publishers violate state provisions by using advertisements to falsely advertise goods or services, and the envy is serious, a sentence of up to two years imprisonment or short-term detention is to be given, and/or a fine. 2. The crime of illegal intrusion into computer information systems is lacking. Article 285 of the Criminal Law:

Whoever violates state regulations by intruding into computer information systems in the fields of state affairs, national defense construction, or cutting-edge science and technology shall be sentenced to up to three years imprisonment or short-term detention. 3. The crime of sabotaging computer information systems. Article 286 of the Criminal Law:

Where state provisions are violated by deleting, modifying, adding, or interfering with the functions of computer information systems, causing the computer information systems to fail to operate normally, and the consequences are serious, a sentence of up to five years imprisonment or short-term detention is to be given; where the consequences are especially serious, the sentence is to be five or more years imprisonment.

Article 287-bis of the Criminal Law.

Where it is clearly known that others are using information networks to commit crimes, and providing them with technical support such as internet access, server hosting, network storage, or communication transmission, or providing assistance such as for advertising and promotion, payment and settlement, and the circumstances are serious, a sentence of up to three years imprisonment or short-term detention is to be given, and/or a fine.

Where a unit commits the crime in the preceding paragraph, the unit is to be fined, and the directly responsible managers and other directly responsible personnel are to be punished in accordance with the provisions of the first paragraph.

Where conduct in the preceding two paragraphs simultaneously constitutes other crimes, follow the provisions for the heavier punishment at trial and sentencing.

Legal basis: Article 246 of the Criminal Law of the People's Republic of China: Whoever publicly insults others or fabricates facts to slander others by violence or other means, and the circumstances are serious, is to be sentenced to up to three years imprisonment, short-term detention, controlled release, or deprivation of political rights.

Where the victim complains to the people's court about the conduct provided for in paragraph 1 through information networks, but it is truly difficult to provide evidence, the people's court may request that the public security organs provide assistance.
