Upstairs is talking about how to register a general company, and social forces need to obtain the approval of the relevant departments before carrying out industrial and commercial registration and obtain a "school license". According to the provisions of Article 11 of the Law of the People's Republic of China on the Promotion of Private Education:
Private schools that carry out academic education, pre-school education, self-study examinations and other cultural education shall be examined and approved by the people's education administrative departments at or above the county level in accordance with the authority prescribed by the state; Private schools that organize and implement vocational qualification training and vocational skills training based on vocational skills shall be examined and approved by the people's labor and social security administrative departments at or above the county level in accordance with the authority prescribed by the state, and a copy shall be sent to the education administrative departments at the same level for the record. This kind of approval is theoretically free of charge. (Regulations are regulations, but whether the actual fees are charged in various places is another matter).
For the materials that should be provided to the examination and approval authorities for the application for the establishment of private schools, please refer to Articles 12 and 14 of the "People's Promotion Law".
In accordance with the above provisions, with the approval of the relevant departments, and after obtaining the "school running permit", you can go through the registration procedures at the industrial and commercial bureau. (If it is academic education, your fee standard must also be approved by the price department) The industrial and commercial bureau shall charge a registration fee, and the standard shall be formulated by each province.
The Law on the Promotion of Democracy stipulates that private education can enjoy preferential tax treatment. As for how to implement tax incentives, it should be formulated by the State Administration of Taxation, the Ministry of Finance, the Ministry of Education and other relevant ministries and commissions, but I have not seen any documents in this regard.
Supplement: The State Administration of Taxation has formulated preferential tax policies that private education can enjoy. For details, please refer to the Notice of the Ministry of Finance and the State Administration of Taxation on Education Tax Policies (Cai Shui [2004] No. 39).
