The General Provisions of the Civil Law of the People's Republic of China is the Civil Code.
The General Provisions set out the basic principles and general provisions of civil activities and play a leading role in the Civil Code. It is divided into basic provisions, natural persons, legal persons, unincorporated organizations, civil rights, civil legal acts, **, civil liability, and statute of limitations.

Legal analysis: The General Provisions of the Civil Law came into force on October 1, 2017. In order to protect the lawful rights and interests of civil subjects, adjust civil relations, maintain social and economic order, adapt to the requirements of the development of socialism with Chinese characteristics, and carry forward the core socialist values, the General Provisions of the Civil Law are formulated on the basis of the Constitution.
Legal basis: Civil Code of the People's Republic of China
Article 1: This Law is formulated on the basis of the Constitution so as to protect the lawful rights and interests of civil subjects, to adjust civil relations, to preserve social and economic order, to meet the requirements of the development of socialism with Chinese characteristics, and to carry forward the Core Socialist Values.
Article 2: The Civil Law regulates the personal and property relations between natural persons, legal persons, and unincorporated organizations that are equal subjects.
Article 4: The legal status of all civil entities in civil activities is equal.
Article 5: Civil entities engaging in civil activities shall follow the principle of voluntariness, and establish, modify, or terminate civil legal relationships in accordance with their own wishes.

The General Provisions of the Civil Law of the People's Republic of China was passed by the Fifth Session of the 12th National People's Congress of the People's Republic of China on March 15, 2017, and is hereby promulgated, to take effect on October 1, 2017.

The General Provisions of the Civil Code came into force in October, opening the "Civil Code Era".
On March 15, the General Provisions of the Civil Law of the People's Republic of China was voted and adopted by the Fifth Session of the 12th National People's Congress and came into force on October 1, 2017. Since then, China's civil legal system has opened the "Civil Code Era". The General Provisions of the Civil Law stipulate the basic civil legal systems such as the basic principles of civil law, civil subjects, civil rights, civil legal acts, civil liability and statute of limitations, etc., which build the basic framework of China's civil legal system and lay the foundation for the compilation of the Civil Code.
After the adoption of the General Provisions of the Civil Law, the specific contents of contracts, ownership and other property rights, civil liability, etc., as stipulated in the current General Principles of the Civil Law, need to be further coordinated and systematically integrated in the compilation of various sub-parts of the Civil Code. Where the provisions of the General Provisions of the Civil Law are inconsistent with the provisions of the General Principles of the Civil Law, the provisions of the General Provisions of the Civil Law shall apply in accordance with the principle that the new law prevails over the old law.

On March 15, 2017, the Fifth Session of the 12th National People's Congress of the People's Republic of China voted to adopt the General Provisions of the Civil Law of the People's Republic of China, which was promulgated by Presidential Order No. 66, and Xinhua News Agency was authorized to broadcast the law in full on March 18. The General Provisions of the Civil Law shall come into force on October 1, 2017.
On May 28, 2020, the Third Session of the 13th National People's Congress voted to adopt the Civil Code of the People's Republic of China, which will come into force on January 1, 2021. The General Provisions of the Civil Law of the People's Republic of China shall be repealed at the same time.
