Article 8 of the Marriage Law stipulates that a man and a woman who wish to marry must register their marriage in person at the marriage registration office. Where the provisions of this Law are met, they shall be registered and a marriage certificate shall be issued. Obtaining a marriage certificate establishes the relationship between husband and wife. Where marriage registration has not been completed, the registration shall be re-registered.
1. Marriage registration formalities are the basis for determining the establishment of marriage in law. According to the provisions of China's current laws and regulations, the marriage registration procedures are greatly simplified compared with before, and it is no longer a troublesome matter. Although there are certain differences in the procedures for marriage registration according to the actual situation in different places, in general, they all have to go through three procedures: application, examination and registration.
2. Both the man and the woman who apply for marriage should apply for marriage registration in person at the marriage registration authority where one party has a household registration and fill in the marriage application. The marriage application must be attended by both parties in person, and cannot be applied by one party alone, nor can it be applied for by entrusting others**.
2. When applying, you should bring your household registration booklet, resident ID card and other documents, and when there are local compulsory marriage inspection regulations, you should also bring a premarital physical examination certificate. When a divorced person applies for marriage or remarriage, he or she should also bring a divorce certificate or a legally effective civil mediation document or judgment granting divorce.
3. Then the marriage registration authority will review the applicant's marriage affection and submitted materials, and if all the marriage conditions are met, it will be registered on the spot and a marriage certificate will be issued; If you don't meet the criteria, you will be told why.
4. Where a divorced man and a woman voluntarily resume their relationship as husband and wife, they shall go to the marriage registration authority to register their remarriage, and the marriage registration authority shall first cancel their divorce certificate and then issue a marriage certificate. From the time the marriage certificate is obtained, the marriage relationship between the two persons is formalized.
