Provisions on the management of taxi business services

The "Regulations on the Administration of Taxi Business Services" was adopted by the 9th ministerial meeting of the Ministry of Transport on September 26, 2014, and promulgated by the Order No. 16 of 2014 of the Ministry of Transport of the People's Republic of China on September 30, 2014. The "Provisions" are divided into 7 chapters and 54 articles of General Provisions, Business License, Operation Services, Operation Guarantee, Supervision and Management, Legal Liability, and Supplementary Provisions, which came into force on January 1, 2015.

Legal basis: "Regulations on the Administration of Taxi Business Services".

Article 1 In order to standardize the taxi business service behavior, protect the legitimate rights and interests of passengers, drivers and taxi operators, and promote the healthy development of the taxi industry, these provisions are formulated in accordance with relevant national laws and administrative regulations.

Article 2 Those engaged in taxi business services shall comply with these provisions.

Article 3 Taxis are an integral part of urban transportation, and shall be compatible with the economic and social development of the city, and shall be developed in coordination with public transportation and other passenger transport services, so as to meet the needs of the people for personalized travel.

Article 4 Taxis shall be operated in accordance with the law, honest and trustworthy, fair competition, and high-quality service.

According to Article 2 of the Notice on Adjusting Several Provisions on the Adjustment of Automobile Scrapping Standards (Guo Jing Mao Resources [2000] No. 1202), "tourist passenger vehicles and non-operating passenger vehicles with more than 9 seats shall be used for 10 years", and Article 3 "If the above-mentioned vehicles need to continue to be used after reaching the end of life, they must be strictly inspected in accordance with the relevant provisions of national motor vehicle safety and pollutant emissions, and the service life can be extended after passing the inspection." However, tourist passenger cars and non-operating passenger vehicles with more than 9 seats can extend the service life for up to 10 years", and the mandatory Xunchun scrapping period of tourist passenger cars is 10 years, and it can be extended for 10 years after passing the inspection.

Legal analysis: Taxi is an integral part of urban transportation, which should adapt to the economic and social development of the city, and develop in coordination with public transportation and other passenger transport services to meet the personalized travel needs of the people. The local people's transportation department at or above the county level shall, in accordance with the economic and social development and the people's travel needs, formulate a taxi development plan in accordance with the functional positioning of the taxi, and report to the people at the same level for approval before implementation.

Article 9 When the applicant applies for taxi operation, the following materials shall be submitted:

1) Application Form for Taxi Business (see Annex 1);

2) The identity and credit certificate of the investor and the person in charge and their copy, and the identity certificate of the person in charge and their copy and the power of attorney;

3) Proof of the right to operate a taxi vehicle and a letter of commitment for the vehicle to be put into operation (see Annex 2), including the number of vehicles, the number of seats, the type and grade, and the technical grade;

D) hired or to hire the driver's qualification certificate and its copy;

5) Taxi management system, safety production management system and service quality assurance system text;

6) Certificates of use of business premises and parking lots.

10th districted city or county level road transport authorities on the taxi business application to be accepted, shall be accepted within 20 days from the date of acceptance of the decision to permit or not license.
