A sea area can only be called the high seas if it is more than 212 nautical miles away from the territory of all countries, and if there is the territory of another country within 414 nautical miles of the mainland or islands of China, the sea area between them cannot be called the high seas.

The high seas are 12 nautical miles from the coast. The 1982 United Nations Convention on the Sea provides that "each State shall have the right to determine the width of its territorial sea", but limits its maximum extent to "a limit not exceeding 12 nautical miles from the baselines established in accordance with this Convention".
