Family Planning Law
Adopted at the 25th Session of the Standing Committee of the Ninth National People's Congress on December 29, 2001.
On December 29, 2001, Order No. 63 of the President of the People's Republic of China was promulgated and came into force on September 1, 2002.
Chapter III: Fertility Regulation.
Article 21 Couples of childbearing age who practice family planning shall enjoy free family planning technical services for the basic items prescribed by the State.
The necessary funds provided for in the preceding paragraph shall be included in the financial budget or guaranteed by social insurance in accordance with the relevant provisions of the State.
Chapter IV: Incentives and Social Security.
Article 23 The State shall give incentives to couples who practice family planning in accordance with regulations.
Article 24 The State shall establish and improve social security systems such as basic old-age insurance, basic medical insurance, maternity insurance, and social welfare, and promote family planning.
The State encourages insurance companies to organize insurance programs that are conducive to family planning.
Localities with conditions can implement various forms of old-age security measures in rural areas according to the principle of first-class guidance and farmers' voluntariness.
Article 25 Citizens who marry late and give birth later may receive incentives or other benefits for extended marriage leave or maternity leave.
Article 26: During pregnancy, childbirth, and breastfeeding, women shall enjoy special labor protection and may receive assistance and compensation in accordance with the relevant provisions of the State.
Citizens who undergo family planning surgery are entitled to leave as prescribed by the state; Local people** can give incentives.
Article 27: Couples who voluntarily give birth to only one child for the rest of their lives shall be issued a "Certificate of Honor for Parents of a Single Child".
Couples who have obtained the "Certificate of Honor for Parents of One Child" shall enjoy the reward of parents of one child in accordance with the relevant provisions of the state and provinces, autonomous regions and municipalities directly under the Central Government.
Where laws, regulations, or rules provide that the unit to which they belong is to give incentives to couples who have only one child for life, the relevant units shall implement it.
Where an only child is accidentally disabled or dies, and his parents no longer give birth to or adopt a child, the local people** shall give necessary assistance.
Article 28 Local people at all levels shall give support and preferential treatment in terms of funds, technology, training, etc., to families practicing family planning in rural areas for economic development; Priority will be given to poor families who practice family planning in the areas of poverty alleviation loans, cash-for-work, poverty alleviation projects, and social assistance.
Article 29: The people's congresses of provinces, autonomous regions, municipalities directly under the Central Government, and larger cities and their standing committees or people's ** may formulate specific implementation measures on the basis of the provisions of this Law and relevant laws and administrative regulations, combined with actual local conditions, as provided for in this chapter.
