Measures for the Administration of Food Production Licenses

Legal analysis: 1. The "Measures for the Administration of Food Production Licensing" is a departmental regulation formulated by the State Administration for Market Regulation to standardize the production licensing activities of food and food additives, strengthen the supervision and management of food production, and prevent food safety in Baolu Town;

2. The "Measures for the Administration of Food Production Licensing" was deliberated and adopted by the 18th meeting of the State Administration for Market Regulation in 2019 on December 23, 2019, and is hereby promulgated to take effect on March 1, 2020.

Legal basis: Measures for the Administration of Food Production Licensing

Article 1 In order to standardize the production licensing activities of food and food additives, strengthen the supervision and management of food production, and ensure food safety, these measures are formulated in accordance with the Administrative Licensing Law of the People's Republic of China, the Food Safety Law of the People's Republic of China, the Regulations on the Implementation of the Food Safety Law of the People's Republic of China and other laws and regulations.

Article 2 In the territory of the People's Republic of China, a food production license shall be obtained in accordance with the law to engage in food production activities. These measures shall apply to the application, acceptance, review, decision and supervision and inspection of food production license.

Article 3 The food production license shall follow the principles of law, openness, fairness, justice, convenience and efficiency.

Article 4 The principle of one enterprise and one certificate shall be implemented for food production license, that is, the same food producer engaged in food production activities shall obtain a food production license.

Article 5 The market supervision and management department shall implement classification and licensing for food production in accordance with the degree of risk of food, combined with food raw materials, production technology and other factors.

Article 6 The State Administration for Market Regulation is responsible for supervising and guiding the administration of food production licenses nationwide. The local market supervision and administration department at or above the county level shall be responsible for the supervision and administration of food production licenses within their respective administrative regions.

The measures are formulated in accordance with the Administrative Licensing Law of the People's Republic of China, the Food Safety Law of the People's Republic of China, the Regulations on the Implementation of the Food Safety Law of the People's Republic of China and other laws and regulations in order to standardize the production licensing activities of food and food additives, strengthen the supervision and management of food production, and ensure food safety. The Measures stipulate that in the territory of the People's Republic of China, food production activities shall be subject to food production licenses in accordance with the law. The application, acceptance, review, decision and supervision and inspection of food production license shall also apply to these measures.
