Giving birth to an illegitimate child in a married manner is suspected of bigamy.
Chinese law does not explicitly stipulate the act of extramarital affairs per se. However, China's Civil Code, Criminal Law and some individual regulations have relevant provisions on abuse, abandonment, bigamy, violent interference with the freedom of marriage, infant drowning, injury, ** and other behaviors that seriously endanger social security caused by extramarital affairs. The above-mentioned acts arising from extramarital affairs must be convicted and sentenced in accordance with the provisions of state law and on different charges in accordance with law, and resolutely and severely punished.
Therefore, if one or both spouses simply have an extramarital affair, it is generally not a crime. However, at this time, it is necessary to distinguish between extramarital affairs and bigamy, because in reality, many extramarital affairs have actually constituted the crime of bigamy. In this case, it is necessary to convict and punish the bigamist party in accordance with the provisions of the Criminal Code.
Article 258 of the Criminal Law [Crime of Bigamy] Whoever marries another person who has a spouse, or who knowingly marries another person with a spouse, shall be sentenced to fixed-term imprisonment of not more than two years or short-term detention.
1. The basic manifestations of extramarital affairs.
1. Forms of adultery that occasionally have sexual relations with the opposite sex outside of marriage;
2. A form of cohabitation that does not live together continuously and stably in the name of husband and wife;
3. A form of bigamy in which husband and wife live together in the name of husband and wife.
Of these three forms, bigamy is a criminal offense punishable by criminal penalties; However, "a spouse cohabiting with another person" only bears civil legal liability, and the innocent party can claim damages on this basis; If you occasionally have sexual relations with the opposite sex outside of marriage, you generally do not bear civil liability. In the event of a divorce caused by adultery, if the innocent party has sufficient evidence, the other party shall bear the responsibility for the fault, and the innocent party shall appropriately divide the property.
What are the circumstances of bigamy?
1. Legal bigamy: refers to the fact that the previous marriage has not been dissolved, and the marriage is registered with another person. In China, where marriage is registered as a single registration, bigamy is constituted as long as both parties have registered their marriage, regardless of whether they are cohabiting or not.
2. De facto bigamy: refers to the former slip or undissolved marriage, and living together with others in the name of husband and wife, but not going through the marriage registration formalities. As long as the parties openly live together in the name of husband and wife, even if the marriage is not registered, it constitutes bigamy.
In any of the following circumstances, it shall be deemed that they are living together as husband and wife:
1) A person with a spouse holds a marriage ceremony with another person;
2) A person who has a spouse has not held a marriage ceremony with another person, but is commensurate with husband and wife or considers himself husband and wife to the outside world.
In addition to the acknowledgment between the parties and the names in daily life, the parties living together, the husband signing and accompanying the husband when the woman is sick, the man signing in the hospital in the name of the father when the woman gives birth to a child, and the party celebrating the full moon for the child in the name of the parents, may also be used as supporting evidence for determining that the husband and wife are commensurate. To determine bigamy, it is usually necessary to obtain the testimony of the surrounding people, relatives and friends of the parties concerned, so as to prove that the surrounding people believe that the parties are husband and wife.

Legal analysis: If an illegitimate child is not married to a third party, it generally does not constitute a crime, but social maintenance fees must be paid in accordance with the law, and if he marries with a third party, he is suspected of bigamy.
Legal basis: Article 200 of the Criminal Law of the People's Republic of China Whoever has a spouse and marries him, or marries another person knowing that he has a spouse, shall be sentenced to fixed-term imprisonment of not more than two years or short-term detention.
